Introduction
Welcome to OutfitLab. These Terms of Service ("Terms") govern your use of the OutfitLab mobile application ("App") operated by OutfitLab ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
Image Processing Policy
At OutfitLab, we emphasize the importance of adhering to both legal and ethical standards when uploading, processing, and sharing images. We ask all users to follow these guidelines:
Ownership and Rights
Users are responsible for ensuring that any images uploaded for processing are either owned by them or they have the necessary rights to use and modify such images. It is the user's obligation to ensure they have proper authorization to use any images they upload to our App.
Respecting Copyright Law
Users must not upload or process images that are protected by copyright unless they have obtained explicit permission from the copyright holder. This includes photographs, artwork, or other visual media protected by copyright.
Respect for Privacy and Personal Rights
Users are prohibited from uploading or sharing images of individuals without their consent when such consent is required by applicable law. This includes images that may violate privacy rights, publicity rights, or other legal protections.
OutfitLab does not condone and cannot be held liable for any unauthorized uploading, processing, or sharing of images that violates copyright law, privacy laws, or other legal protections. Users are fully responsible for ensuring their activities on the App comply with all applicable legal requirements.
By using our App, you agree to indemnify OutfitLab against any legal consequences resulting from the unauthorized use or distribution of images. We trust our users to respect intellectual property, privacy, and applicable laws while using OutfitLab.
License to Use OutfitLab
Provided you comply with these Terms of Service, OutfitLab grants you a limited, personal, non-exclusive, non-commercial, revocable, and non-transferable license to access and use the App and its features. This is strictly for personal use.
You agree not to copy, record, or access the App via automated means (e.g., scripts, bots, or data extraction tools) unless authorized by OutfitLab in writing.
If you purchase a subscription or license to access Pro features of OutfitLab, it is for individual use only and cannot be shared with others. We may enforce reasonable limits on access to protect against unauthorized use, including limits on device usage or the quantity of images processed.
User Content
When you upload images or other content to OutfitLab:
- You retain all ownership rights to your content.
- You grant OutfitLab a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use your content solely for the purpose of providing and improving our services, including processing your images to generate new ones.
- This license ends when you delete your content or your account, except to the extent your content has been shared with others and they have not deleted it.
Prohibited Uses
You agree not to use OutfitLab:
- For any unlawful purpose or to violate any laws or regulations.
- To upload, process, or share images containing illegal, explicit, harmful, or offensive content.
- To infringe or violate the intellectual property rights or other rights of any person or entity.
- To harass, abuse, or harm another person, or to attempt to do any of the above.
- To engage in any activity that could damage, disable, overburden, or impair the functioning of OutfitLab.
Inappropriate Content and Credit Consumption
Please note that if you attempt to upload, process, or generate images containing inappropriate, prohibited, or otherwise restricted content, your request may consume credits but will not result in generated output. Credits consumed in these cases are non-refundable, as the processing resources are still utilized by our systems.
Fair Use Policy
OutfitLab is designed for reasonable personal use. To ensure all users receive consistent and reliable service, we implement a Fair Use Policy:
Usage Limitations
- We reserve the right to limit the number of images you can generate within a specific time period based on your subscription tier.
- Free tier users may have stricter limitations compared to Pro subscribers.
- The quality and resolution of generated images may vary based on your subscription level.
Abuse Prevention
- Any automated, excessive, or abusive usage patterns may result in temporary or permanent restrictions to your account.
- Abuse includes but is not limited to: scripted mass generation of images, attempting to circumvent usage limits, or creating multiple accounts to exceed free tier limitations.
- In cases of detected abuse, OutfitLab reserves the right to:
- Temporarily limit the number of images you can generate
- Reduce the quality of generated images
- Suspend or terminate your account without prior notice
- Restrict access to certain features of the App
Service Optimization
These limitations are in place to prevent service degradation for all users. OutfitLab continuously monitors system usage to balance resources fairly across our user base while maintaining optimal performance.
Refund Policy for OutfitLab
1. Apple App Store Purchases
If you purchased a subscription through the Apple App Store:
- Refund requests for subscriptions or in-app purchases must be submitted directly to Apple, not to OutfitLab.
- To request a refund from Apple:
- Open the App Store app
- Tap your profile icon
- Tap "Purchased"
- Find the OutfitLab transaction
- Select "Report a Problem"
- Follow Apple's instructions to request your refund
Apple maintains sole discretion over approving or denying refund requests for purchases made through their platform. OutfitLab cannot process, approve, or influence refund decisions for Apple App Store purchases.
2. Direct Purchases (If Applicable)
For purchases made directly through OutfitLab (not through the Apple App Store), the following policy applies:
Eligibility for Refunds
Refunds are generally only available under the following conditions:
- You are within the first 30 days of your subscription purchase or renewal.
- The subscription was not used excessively or in violation of our Terms of Service.
- Technical issues that are caused by OutfitLab and could not be resolved within a reasonable time after the issue was reported.
- Accidental or duplicate payments.
No Refunds for Inactive Accounts
We do not provide refunds for unused or inactive accounts. If you forget to cancel your subscription and it renews automatically, you are still responsible for that charge. Please ensure you manage your subscription settings in your account.
Refund Request Process for Direct Purchases
To request a refund for direct purchases:
- Email our support team at [outfitlabapp@gmail.com] with the subject line "Refund Request."
- Include the following details: your name, email address, subscription plan, and the reason for your refund request.
- Our team will review your request and respond within 5-7 business days.
Pro-Rated Refunds
If you cancel your subscription partway through a billing cycle, you may be eligible for a pro-rated refund based on the number of unused days in the billing period.
Non-Refundable Cases
- Refund requests made after 30 days of subscription purchase.
- Refunds for promotional offers, discounts, or special pricing.
- Monthly subscription fees after the initial 30-day period.
- Termination of your account due to a violation of our Terms of Service.
Payment Processing Time
Once your refund request is approved, the refund will be processed through the original payment method. Depending on your financial institution, it may take up to 7-14 business days for the funds to appear in your account.
Limitation of Liability
To the maximum extent permitted by law, OutfitLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the App;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
Changes to Terms
OutfitLab reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the App.
